The Los Angeles District Attorney's office announced today that it is changing its policy concerning the timing of motions to vacate filed under Penal Code 1473.7. Since its inception, PC 1473.7 motions in Los Angeles have been opposed by the DA if the applicant was not yet facing ICE removal proceedings. We support this change, as we believe not requiring the applicant to already be in removal proceedings conforms more closely to the intent of the law.
